Sundog – Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Sundog ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Health and Medical Disclaimer

The App provides general information and guidance about sun exposure based on UV index data, your stated skin type, and your personal goals. This information is educational and informational only.

The App is not:

• A medical device
• A source of medical advice, diagnosis, or treatment
• A substitute for consultation with a qualified dermatologist or physician
• Intended to diagnose, treat, cure, or prevent any skin condition or disease

Sun exposure is highly individual. Factors such as medications, medical conditions, personal health history, cloud cover, reflective surfaces, altitude, and geographic location can significantly affect how your skin responds to UV radiation in ways the App cannot account for. Always exercise personal judgment and consult a healthcare professional if you have concerns about sun exposure.

3. Sun Exposure at Your Own Risk

You acknowledge and agree that:

• Any sun exposure you undertake based on or in connection with the App is done entirely at your own risk.
• The suggested exposure durations are estimates based on general guidelines and publicly available UV data. They are not personalized medical recommendations.
• Sunburn, skin damage, heat illness, and other adverse effects can occur even when following the App's guidance.
• You are solely responsible for protecting yourself and any minors in your care from the risks of sun exposure.
• You should always apply appropriate sun protection measures (sunscreen, protective clothing, shade) based on your personal circumstances, regardless of what the App suggests.

4. App Provided "As Is"

Sundog is provided on an "as is" and "as available" basis, without warranty of any kind. We make no representations or warranties that the App will be accurate, error-free, uninterrupted, or suitable for your particular purpose.

UV index data is sourced from third-party weather services and may be inaccurate, delayed, or unavailable. Weather conditions can change rapidly. The App's recommendations reflect conditions at the time of the last data update and may not reflect current conditions.

6. Eligibility

You must be at least 13 years of age to use Sundog. By using the App, you represent that you meet this requirement. If you are under 18, you should review these terms with a parent or guardian.

7. Intellectual Property

All content, design, graphics, and code within the App are the property of the Sundog developers. You may not reproduce, redistribute, or create derivative works from any part of the App without express written permission.

8. Changes to the App and These Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms of Service at any time. The updated terms will be effective upon posting. Continued use of the App after changes constitutes your acceptance of the new terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

2. Aviso de salud y médico

La App proporciona información y orientación general sobre la exposición solar basándose en datos del índice UV, tu tipo de piel declarado y tus objetivos personales. Esta información es únicamente educativa e informativa.

La App no es:

• Un dispositivo médico
• Una fuente de consejo, diagnóstico o tratamiento médico
• Un sustituto de la consulta con un dermatólogo o médico calificado
• Destinada a diagnosticar, tratar, curar o prevenir ninguna afección o enfermedad cutánea

La exposición solar es muy individual. Factores como medicamentos, condiciones médicas, historial de salud personal, nubosidad, superficies reflectantes, altitud y ubicación geográfica pueden afectar significativamente la respuesta de tu piel a la radiación UV de maneras que la App no puede contemplar. Ejerce siempre tu juicio personal y consulta a un profesional de la salud si tienes dudas sobre la exposición solar.

3. Exposición solar bajo tu propia responsabilidad

Reconoces y aceptas que:

• Cualquier exposición solar que realices basándote en la App o en conexión con ella es bajo tu exclusiva responsabilidad.
• Las duraciones de exposición sugeridas son estimaciones basadas en pautas generales y datos de UV públicamente disponibles. No son recomendaciones médicas personalizadas.
• Las quemaduras, el daño cutáneo, las enfermedades por calor y otros efectos adversos pueden producirse incluso siguiendo las indicaciones de la App.
• Eres el único responsable de protegerte a ti mismo y a los menores a tu cargo de los riesgos de la exposición solar.
• Debes aplicar siempre las medidas de protección solar adecuadas (protector solar, ropa protectora, sombra) según tus circunstancias personales, independientemente de lo que sugiera la App.

4. App proporcionada "tal como está"

Sundog se proporciona "tal como está" y "según disponibilidad", sin garantía de ningún tipo. No hacemos representaciones ni garantías de que la App sea precisa, esté libre de errores, sea ininterrumpida o sea adecuada para tu propósito particular.

Los datos del índice UV provienen de servicios meteorológicos de terceros y pueden ser inexactos, estar retrasados o no estar disponibles. Las condiciones meteorológicas pueden cambiar rápidamente. Las recomendaciones de la App reflejan las condiciones en el momento de la última actualización de datos y pueden no reflejar las condiciones actuales.

6. Elegibilidad

Debes tener al menos 13 años para usar Sundog. Al usar la App, declaras que cumples este requisito. Si eres menor de 18 años, debes revisar estos términos con un padre, madre o tutor.

7. Propiedad intelectual

Todo el contenido, diseño, gráficos y código de la App son propiedad de los desarrolladores de Sundog. No puedes reproducir, redistribuir ni crear obras derivadas de ninguna parte de la App sin permiso expreso por escrito.

8. Cambios en la App y en estos Términos

Nos reservamos el derecho a modificar o interrumpir la App en cualquier momento sin previo aviso. También podemos actualizar estos Términos de Servicio en cualquier momento. Los términos actualizados entrarán en vigor al publicarse. El uso continuado de la App tras los cambios constituye tu aceptación de los nuevos términos.

9. Ley aplicable

Estos Términos se regirán e interpretarán de conformidad con la ley aplicable. Cualquier disputa que surja en virtud de estos Términos estará sujeta a la jurisdicción exclusiva de los tribunales competentes.
